The Kathmandu Post Saturday, june 19, 2004 Govt readies SEZ Ordinance Plans rosy incentives to promote industries POST REPORT KATHMANDU,June 18 The government has prepared the Special Economic Zone (SEZ) Ordinance 2004 that offers longer tax holidays, tax exemptions on row material imports and other incentives to industries to established in the SEZ. The SEZ will mainly accommodate export industries and special business uints that would help achieve long-term industrial development." The draft Ordinance will be retified withim this fiscol year,” a source told the Post. The Ordinance pledges special fiscal and financial incentives to industries in the Zone. he said. However, the draft Ordinance maintains silence on abor regulations, which are otherwise strict and industryriendly in such Zones. The SEZ will basically accommodate six types of industry. These include tourism and entertainment, export-oriented IT, export-oriented agriculture, mining and forestry, other exprot-orientated manufacturing industries, the research and development industries and the human resource development industry. It pledges a duty-free improt facility for row materials, machinery, equipmeat and other supprot systems ro all industries in the Zone and also exempts their improts from Value Added Tax (VAT) . “No excise duty will be imposed on SEZ products,” states the ordinance, which forther incorporates protracted income tax holiday provisions for these industries. to the tourism and entertainment industries, it pledges a tax holiday of 5 years to units making an investment of US S100 thousand to 300 thousand. the same has been extended to 10 and 15 years to units that would operate with investment of US s300 thousand to 500 thousand, and US s500 thousand and above, respectively. for units falling under the categories of exprot-oriented IT, agro-based, mines and forestbased, and other manufacturing industries, tax holidays of 5 and 10 years have been pladged if their investmants fall in the range of US s100 thousand to 500 thousand and US s500 thousand to 1 million, respectively. Likewise, tax holiday have been extended for 15 and 20 years respectiveky if these enterprises are established with investment of US s1 million to 2 million, or of US s2 million and above. five years, additional tax holiday ( that is, 25 years in total ) has been pledged to exprot-oriented agro-based, mines and forest-based and other manufacturing industries whose investment ru………….over US s4 million. Income tax holidays have been pledgad for the lifetime of export-oriented handicrafts industries. The Ordinance notes thet research and developmant industries launchig with investment of US s50 thousand to 100 thousand , US s100 thousand to 500 thousand and above, respectively, would enjoy tax holidays for 10, 15 and 20 years. The same facility of 5, 10 and 15 years will be applicable to HRD industries launching with investment of US s25 thousand to 100 thousand,US s100 thousand to 500 thousand and US s500 thousand and above respectively, as provisioned in the Ordinance. For the industries established in the Mid and Far Western regions, an additioal 5 year tax holiday has been offered. These regions have also been promised with 25 percent income tax exemption after the tax holiday expires. Institutions lending capital to the EPZ-based industries also have been exempted from tax on interest earnings, while foreign experts employed by these industries have been excluded from tax net for the first three years. The Ordinance guarantees investors a facility of 100 percent repatriation of earnings in convertible currency, but limits the facility to 25 percent of the salary income in case of foreign workers.The Ordinance, aiming to build inverstor confidence, provisions that new amendments will never reduce the facilities offered to such industries. It cites the establishment of an autonomous SEZ Authority to oversee administrative works and provide one-window service delivery. The Authority will be accountable to a high-level council,which will be headed by the ministry Idustry.

The same facility of 5, 10 and 15 years will be applicable to HRD industries launching with investment of US s25 thousand to 100 thousand,US s100 thousand to 500 thousand and US s500 thousand and above respectively, as provisioned in the Ordinance. For the industries established in the Mid and Far Western regions, an additioal 5 year tax holiday has been offered. These regions have also been promised with 25 percent income tax exemption after the tax holiday expires. Institutions lending capital to the EPZ-based industries also have been exempted from tax on interest earnings, while foreign experts employed by these industries have been excluded from tax net for the first three years. The Ordinance guarantees investors a facility of 100 percent repatriation of earnings in convertible currency, but limits the facility to 25 percent of the salary income in case of foreign workers.The Ordinance, aiming to build inverstor confidence, provisions that new amendments will never reduce the facilities offered to such industries. It cites the establishment of an autonomous SEZ Authority to oversee administrative works and provide one-window service delivery. The Authority will be accountable to a high-level council,which will be headed by the ministry Idustry.
